Section 8 – Constitution of India, 1950; Article 191(1)(e) – Whether conviction under the Prevention of Insult to National Honour Act is one of the grounds for disqualification under Section 8 read with Article 191(1)(e) – The question is of great importance – Matter to be heard by the Constitution Bench.
1. One of the questions raised in these Special Leave Petitions is whether conviction under the Prevention of Insult to National Honour Act is shown one of the grounds for disqualification from membership of the State Legislature under Section 8 of the Representation of the People Act read with Article 191 (1)(e) of the Constitution. We think that the question is of great importance and the matter should be heard by the Constitution Bench. Special leave granted.
2. Issue notice on application for interim directions. Pending further orders the petitioners will not be dispossessed from the quarters which they are occupying. Also issue notice to the Advocate General, Tamil Nadu and Attorney General of India.
