Reinstatement in service – Penalty imposed modified – Penalty of reduction by two stages in the time scale imposed.
JUDGEMENT:
O R D E R
1. Special Leave granted. After hearing the learned counsel of the parties we modify the penalty imposed on the appellants as follows:
2. The orders dismissing the appellants are set aside. The appellants are re-instated in service but a penalty of reduction by two stages in the time scale of their pay is imposed for a period of two years without commulative effect. The appellant will not earn increments during the pendency of the penalty. The appellants are not entitled to any back wages till the date of re-instatement. The continuity of service shall, however, be maintained. The appellants should report for duty within four weeks at the place at which they were working formerly and take a posting order from the authority concerned. The appeals are accordingly allowed to the above extent. No Costs.
