At the hearing of the case Shri Kuldeep Singh, Addl.Solicitor General has produced before us the record of the Selection Committee which reviewed the select list in accordance with the directions of the Central Administrative Tribunal Hyderabad and that the said record shows that the Selection Committee has included K.Ch. Venkata Reddy, respondent herein, at the appropriate place in the Select List. In view of the above said fact the learned Addl. Solicitor General states that Government will stand by the recommendation made by the Selection Committee and deal with it in accordance with the Rules. He, however, submits that the observations made by the Central Administrative Tribunal in the course of its order which affect the powers of the Selection Committee of U.P.S.C. may be set aside. Shri A. Subba Rao, learned counsel for the respondent, has no objection to our setting aside the said observations. We have gone through the judgement of the Central Administrative Tribunal. We feel that some of the observations made by the Tribunal are contrary to law. We,therefore, set aside the judgment of the Tribunal but the selection made by Selection Committee in pursuance of the Tribunal’s order shall, however, stand. The appeal is accordingly disposed of. No costs.
