Termination of service – Dispute settled between appellants and ~4~ Order of High Court cancelling appointment substituted by a direction of reinstatement of the appellants with continuity of service and 50% backwages.
1. When the above C.M.P. was taken up for hearing Sri A.K. Goel , learned counsel for the appellant and Sri R.N.Keshwani learned counsel for respondents Nos. 3,4, and 5 in the above civil appeals submitted that the dispute involved in C.A. Nos. 1693-94/80 had been settled between the appellant and respondents nos. 3,4,& 5 and that the appeals might be disposed of setting aside the order of cancellation of appointment of the appellants dated 22.10.79 and directing the reinstatement of the appellants with continuity of service. They further submitted that the appellant would be entitled to 50% of back wages for the period intervening the date of relieving and the date of rejoining and that they would also be entitled to all other service benefits in accordance with rules.
2. We do not find any impediment in making an order in the above terms in substitution of the order passed by the High Court dated the 22nd November, 1979 in Civil Writ Petition No. 3831 of 1979 on the file of Punjab and Haryana High Court. We pass an order in the above terms in substitution of the order of the High Court. The appeals are accordingly allowed.
Appeals allowed.
