We have delivered our separate judgments. In the light of the reasons stated by us, the impugned orders (O.M. No. 36012/31/90-Estt(SCT) dated 13th August, 1990 and O.M. No. 36012/31/90-Estt(SCT) dated 25th September, 1991) issued by the Government ofIndia are declared unenforceable for want of valid identification of backward classes of citizens qualified for reservation under Article 16 of the Constitution of India. In the circumstances, we direct the Union of India to re-examine the question of identification of the backward classes of citizens in accordance with the principles and directives contained in our respective judgments and pass appropriate orders providing for reservation under Article 16(4).
The above cases are disposed of accordingly. There shall be no order as to costs.
