Reinstatement of workmen in service with 60% back wages with continuity in service – Arrears of back wages to be deposited by the management in the Labour Court in four equal quarterly instalments – 12% interest to be paid in case of default in any instalment.
JUDGEMENT:
O R D E R
1. Special leave granted.
2. The Judgment of the High Court is modified The workmen shall be reinstated in service within one week from today with 60% of the back wages. The workmen are entitled to all other attendant benefits and continuity of service. The arrears of back wages shall be deposited in the Labour Court. The management is granted time to pay the arrears in four equal quarterly instalments. The first instalment shall be deposited on 1st March, 1988. In default of payment of any instalment, the management shall pay interest at 12% per annum. The appeal is accordingly disposed of with no orders to costs.
