Terrorist and Disruptive Activities (Prevention) Act, 1987:
Grant of bail – Petitioner is enlarged on bail subject to stipulated conditions.
1. Both the Special leave petition and Criminal Appeal are directed against the judgment and order of the Designated Court (B.B.C., Greater Bombay) rejecting the application filed by the petitioner- accused for discharging him and/or in the alternative for bail. By our order dated 19th August, 1994 notice was granted in these matters only to the extent of bail.
2. We heard the learned counsel for the petitioner and the learned counsel for the respondent.
3. The petitioner Abu Azim Azmi is enlarged on bail pending disposal of B.B.C. No.1 of 1993 subject to the following conditions:
1. He shall furnish a personal bond in a sum of rupees one lakh with two sureties in the like sum to the satisfaction of the Designated Court.
2. He surrenders his passport to the C.B.I. and further gives undertaking not to travel abroad except under the permission of the Designated Court.
3. He shall report twice a week, Monday and Thursday, in the office of the C.B.I., Bombay. The C.B.I. can designate such officer as they may think appropriate to whom the petitioner shall report as also the time of reporting.
4. The petitioner shall not go out of the city of Bombay except after obtaining the permission in writing of the C.B.I.
4. The Special leave petition and Criminal Appeal are disposed of accordingly. No separate orders are called for in the Criminal Miscellaneous Petitions.
