Fact finding committee constituted by the Union Health Ministry to inquire into the affairs of Gastroenterology Department of the PGI, Chandigarh – Committee to proceed with the work – Petitioner-Head of the Department to be given fullest opportunity of hearing and defending himself if any adverse inference is drawn against him.
After hearing Shri G.L. Sanghi learned counsel for the petitioner and Dr. Chitale Senior Advocate appearing on behalf of respondent No.1 and 5, I deem it is just and order to dispose of this Special Leave Petition at this stage by directing that the fact finding committee which has been constituted under the order of Respondent No.1 may continue to proceed with the work of the Committee but if any adverse inference against the peti-tioner is drawn then they will not act on it without giving the petitioner fullest opportunity of hearing and defending himself including the usual procedure of citing witnesses, examination and cross examination of witnesses as he may desire. The Spe-cial Leave is disposed of accordingly.
