Transferred employee – Fixation of seniority at the place to which transferred – Whether previous service to be taken into account – Issues framed.
JUDGEMENT:
ORDER
1. Issue notice returnable within 2 weeks and is limited to the following two questions:
(1) Whether the employee of the N.T.C. will continue to be the employee of the N.T.C. at the place to which he or she is transferred and
(2) Whether the previous service put in by the transferred employee would be taken into consideration for fixing the seniority at the place to which he or she is transferred. If the transferred employee go and report to the place to which they are transferred within two weeks their services shall not be terminated.
2. Dasti service is permitted in addition to the usual mode of service. No stay.
