Andhra Pradesh State and Subordinate Services Rules, Rule 33(c) – Question of inter se seniority – All the relevant aspects not taken into consideration by the Govt. of A.P. or the Administrative Tribunal – State Govt. directed to examine the matter afresh in the light of provisions contained in r.33(c).
1. Special leave granted. Arguments heard.
2. After hearing learned Counsel for the parties, we are not satisfied that all the relevant aspects have been taken into consideration by the Government of Andhra Pradesh or the Administrative Tribunal in determining the inter se seniority as between the appellant and the other concerned Junior Assistants including particularly respondent No.2, J. Kameswara Rao. In the circumstances, we consider it necessary to direct the State Government to examine the question of inter se seniority afresh in the light of the provision contained in r.33(c) and other relevant rules of the Andhra Pradesh State and Subordinate Services Rules.
3. The appeal is accordingly disposed of with these directions. The parties shall bear their own costs.
