This appeal is by special leave and is directed against the judgment of the learned Single Judge of the Punjab and Haryana High Court as affirmed in Letters Patent Appeal. The appellant was a Sub-Inspector in the Department of Food and Supplies. The facts of his case are same as those in Mohinder Singh v. State of Haryana & Ors. (Civil Appeal No. 294 of 1982) which we have disposed of today. For the reasons indicated in the said judgment, the appeal is allowed and the Respondent-State as also the Haryana Public Service Commission are called upon to consider his claim to be recruited to the post of District Food and Supplies Officer on the basis of the notification for recruitment made in 1980. The appellant shall have his costs. Hearing fee is assessed at Rs. 1,000/-.
