Appointment of arbitrator by consent of parties – Arbitrator to continue proceedings from the stage it was left before the Registrar, Co-operative Societies – Arbitrator to give reasoned award and the same will be an award under the Act.
1. Special leave granted and the appeal is disposed of by the following order:
The disputes between the parties, pending before the Registrar of Co-operative Societies, Chandigarh, are referred to the arbitration of Sree H.L. Anand, former Judge of the Delhi High Court by consent of both the parties. He will continue the proceedings from the stage at which it was left by the Registrar, Co-operative Societies, the arbitrator and on the evidence already recorded. The said arbitrator would give reasoned award within a period of 4 months from entering upon the reference. He will enter upon the reference within three weeks of the receipt of the copy of this order. His remuneration and incidental charges will be shared equally by both the parties which are to be fixed by Sree Anand. The said award to be made by him will be an award under the Arbitration Act, 1940. Costs of the proceeding here will be costs in the arbitrator proceeding. The appeal is disposed of accordingly.
