State of affairs in Central Jail, Gwalior – Report submitted by the District Judge – Female lunatics lodged in the same wards with those who are violent – State Govt. to make separate arrangement.
1. No one appears on behalf of the petitioners. It appears that the District Judge, Gwalior was directed to submit his report in respect of the grievances made in the writ petition about the state of affairs in central Jail, Gwalior where lunatics and those who are convicts are kept. The report of the District Judge, Gwalior, is a detailed report.
2. The points raised in the petition have been considered and it appears that on the whole the District Judge, Gwalior seems to be satisfied that these lunatics are kept in detention in Gwalior Central Jail because Gwalior has a mental hospital fully equipped for treatment, as the report of the District Judge indicates that most of them who are kept in detention, they are all receiving treatment in spite of the fact that some of them have become incurable.
3. The only point made in the report of the District Judge is about the female lunatics. According to the report they are lodged in the same ward including those who are violent and it appears that the learned District Judge was informed that because of lack of accommodation, it is not possible for the Jail authorities to provide separate place for detention to those female lunatics who are violent and this was found by the learned District Judge not to be satisfactory. In view of the report of the District Judge, as discussed above, things appear to be satisfactory except to make adequate arrangement for female lunatics so that those who are violent, may be separately detained.
4. We, therefore, direct that the State Government will make adequate arrangement for that purpose. The Writ Petition is disposed of accordingly.
