JUDGEMENT:
O R D E R
1. Special leave granted.
2. We have heard learned counsel for the appellant and Mrs. B. Datta, Additional Solicitor General. Taking all aspects of the case into consideration we feel that the appellant should be directed to be appointed as a Lower Division Clerk in the North Eastern Railway for which the minimum qualification prescribed is Matriculation examination. We direct that the appellant shall be so appointed within three months from today. The arrears of salary, if any, payable to the appellant for the post he is now holding may be disbursed within 15 days.
3. The appeals are accordingly allowed. No costs.
