1. Leave granted.
2. In this case respondents were convicted under Section 325 of the Indian Penal Code and the High Court has given the benefit to the respondents under Section 360 of the Code of Criminal Procedure. Dissatisfied with the same, the injured-aggrieved parties have come before us with this appeal after obtaining permission to file the special leave petition.
3. But during the pendency of this case a new development took place. The appellants and accused – respondents have come to terms and settled their grievances. An affidavit has been sworn to by the Up Pradhan, Panchayat Samiti, Rajgarh (Churu) stating that the compromise petition has been signed in his presence by the parties. A petition for grant of permission for compounding the offence has also been filed.
4. We grant permission for compounding the offence. Accordingly, we dispose of this appeal by acquitting the respondents under Section 320(8) of the Code of Criminal Procedure.
