Petition(s) for Special Leave to Appeal (Crl.) No. 109/2000
(From the Judgment and Order dated 14/12/1999 in CRLMP 10684/99 in CrlOP 18078/99 of the High Court of Madras)
Criminal Procedure Code, 1973
Bail – Conditions of bail – Petition seeking relaxation of condi-tions – Petitioner seeking change of place of police station for causing appearance during bail period – Such plea not put forth before High Court which granted bail subject to certain condi-tions. Held no interference called for SLP ordered to be dis-missed.
1. Upon Motion taken on Board.
2. It is submitted by learned counsel for the petitioner that condition No. 1 imposed by the High Court may be relaxed to the extent that the place of appearance of the petitioner is changed from Race Course Police Station, Coimbatore to any other Police Station nearby Nagapattinam.
3. From the application filed by the petitioner in the High Court seeking relaxation of the conditions of bail, we find that no such plea has been taken. We are not inclined to interfere with the order of the High Court and dismiss this special leave peti-tion.
4. However, in the interest of justice we grant liberty to the petitioner to approach the High Court afresh for seeking relaxa-tion and modification of condition No. 1 and as and when such an application is made, the same should be disposed of on its own merits by the High Court.
Court Master.
