Practice and Procedure
Special Leave Application – Withdrawal of – Review proceedings pending before High Court. Held. As the judge, seized of the proceed-ings, was stated to be away, petitioner directed to request the Chief Justice of High Court to expedite the review proceedings within two months. In view of pendency of review application, SLP application permitted to be withdrawn with liberty to revive after the review petition is decided.
1. Learned senior counsel for the petitioner states, on instruc-tions, that the review proceedings are pending before Hon’ble Mr. Justice S.H.A. Raza and as the learned Judge is at Lucknow the review proceedings have not been processed further. If that is so, it will be open to the petitioner to request the Hon’ble Chief Justice of the High Court to do the needful in this connection according to rules so that the learned Judge can be enabled to consider the review proceedings at his earliest con-venience and preferably within two months from today.
2. In view of the fact that the review proceedings are pending, this petition is permitted to be withdrawn at this stage.
3. The petitioner will be at liberty to revive these proceedings after the review petition is decided, if an occasion arises for it to get these proceedings revived.
4. The Special Leave Petition stands dismissed as withdrawn.
