Code of Criminal Procedure, 1973; section 197 – Question relating to the absence of sanction under section 197 – As the question involved independent consideration, the SLP delinked from the present Criminal Appeal – SLP to be heard by an appropriate Bench.
The only ground taken in the application is the absence of sanction under Sec. 197 of the Code of Criminal Procedure. This involves consideration of an independent question and in the facts and circumstances of the case we de-link this special leave petition from the present Criminal Appeal No. 468/86 which we are dealing with. This special leave petition will come up for consideration before an appropriate Bench. Parties will be at liberty to mention before Hon’ble the Chief Justice of India for an appropriate Bench after the disposal of Criminal Appeal.
