2008 Delhi Blasts Case: Court issues warrant against Hyderabad jail official for failing to produce accused

New Delhi: Raising concerns over delay in the ongoing trial in the September 2008 Delhi serial blasts case, a Delhi court has imposed a penalty and issued warrant against a jail superintendent in Hyderabad for failing to produce two accused persons for recording of evidence.
Additional Sessions Judge Reetesh Singh, who is recording prosecution evidence in the case, has issued bailable warrant against superintendent of Chanchalguda jail in the sum of Rs 50,000. The order came after the jail superintendent failed to produce the two accused, Akbar Ismail Chaudhary and Mohammed Sadique Israr, before the court. They have not been produced before the court for four consecutive hearings.
Thirteen suspected members of Indian Mujahideen are facing trial in connection with the blasts in which 26 people were killed and 135 injured. Five cases were lodged in connection with the blasts at Gaffar Market in Karol Bagh, Barakhamba Road in Connaught Place, M-Block Market in Greater Kailash and recovery of a bomb near India Gate.

“The absence of the accused Akbar Ismail Chaudhary and Mohd Sadique Israr… the trial of this case has not proceeded for the past 2-3 dates. It appears to this court that there is a definite lapse on the part of the superintendent… by not honouring the production warrants issued by this Court and not even sending any communication as to why these two accused persons could not be produced before this Court,” the judge observed in the last hearing on February 20. The court also imposed a penalty of Rs 20,000, stating that it shall be recovered from his salary. After non-compliance of its February 20 order, the court issued the bailable warrant.
“On the last date of hearing, the accused Akbar Ismail Chaudhary and Mohd Sadique had not been produced. There is nobody present from Chanchalguda Jail… to explain the non-compliance of the order. There is also no report regarding compliance on the fine imposed…” observed the judge.
The 13 accused facing trial in the case are Mohd Shakeel, Mohd Saif, Zeeshan Ahmed, Zia-ur-Rehman, Saquib Nisar, Mohd Sadique, Kayamuddin Kapadia, Mohd Hakim, Mohd Mansoor Ashgar Peerbhoy, Mubin Kadar Sheikh, Asif Bashiruddin, Mohd Akbar Ismail Chaudhary and Shahzad Ahmed.
